Unacceptable that govt bodies still failing to answer citizen queries – Environment

first_img <a href=’http://revive.newsbook.com.mt/www/delivery/ck.php?n=ab2c8853&amp;cb={random}’ target=’_blank’><img src=’https://revive.newsbook.com.mt/www/delivery/avw.php?zoneid=97&amp;cb={random}&amp;n=ab2c8853&amp;ct0={clickurl_enc}’ border=’0′ alt=” /></a> The Commissioner for Environment and Planning openly criticises governmental entities under its purview, for their increased delays and failure to respond or acknowledge citizen’s complaints.In their annual report for 2018, the Environment Commissioner acknowledges an 8% increase in the number of complaints that faced an undue delay or were not acted upon, from 26% in 2017 to 34% in 2018.The Commissioner stresses that despite evidence of reductions in other areas like ‘Discriminatory Treatment’ (5% – 4%) and ‘Lack of fairness and balance’ (21% – 18%), the 8% increase in ‘Undue delay or Failure to Act’ needs to be ‘addressed.’‘Other than a simple acknowledgement, complainants are entitled to a reply within a reasonable period of time – in other words within weeks and months – so that they can seek the relevant advice on the basis of the same reply. Citizens cannot stay for months on end in limbo wasting time reminding and chasing the same entity for a reply,’ the Commissioner reports.Going further, the Commissioner stresses that such an inability to provide an answer is surprising given that, ‘the ordinary citizen is expected to reply or make a substantial payment with a few weeks, it is unacceptable that Government entity – that is more equipped and specialised than the same citizen – takes months to answer such queries.’Case load increases for CommissionersThis annual Commission report for 2018 is just one of three reports accompanying the main Parliamentary Ombudsman report.The Parliamentary Ombudsman’s Annual Report 2018, the office dealt with 553 complaints, 33 more than 2017 (6%). However, the Parliamentary Ombudsman saw fewer than 7% last year (313 – 2018 / 336 – 2017). In contrast, there were increases seen across the Commissioners for Education, Environment and Planning and Health.In numbers, the Education Commissioner saw 54 cases compared to 39 last year (up 38%), Environment and Planning 84 compared to 62 (up 35%) and Health saw 102 compared to 83 (up 23%).The Parliamentary Ombudsman’s cases still remained 57% of the total case load for 2018.Ombudsman Report: Cases increase by 6% in 2018Sustained cases halved but one case can make all the differenceWhile the Commissioner stresses that the number of sustained cases halved in 2018 from 2017, ‘these should not be underestimated.’They state that even one sustained or ‘unrectified’ case has serious consequences for Malta’s cultural heritage as well as having a lasting impact for a family.‘These should never be underestimated as one sustained case can mean the permanent loss of cultural heritage that could have been enjoyed by future generations in years to come and one unrectified sustained case can mean that a complainant and his family have to endure living in their most valuable possession adjacent to an irregularly approved development causing them nuisance for these rest of their lives,’ the Commissioner stresses.Half of 2018 complaints focused on Planning Authority Half of the Commissioner’s caseload for 2018 pertained to complaints received over the Planning Authority, the highest number received of all the entities, 42 of 84 total complaints.In addition, of these 84 cases, the majority of them (32) referred to a, ‘Decision contrary to law or rigid application of rules.’This accounted for a 1% increase on 2017, from 37% to 38% in 2018.WhatsApp SharePrintlast_img read more
